Shortly after appellant Eduardo Ferrer Bolivar (“Ferrer”) instituted the present action against appellee Herbert Pockling-ton in March 1990, Pocklington moved to dismiss the complaint, and for the imposition of sanctions under Fed.R.Civ.P. 11 and 28 U.S.C. § 1927. 1 Ferrer responded with a timely notice of voluntary dismissal under Fed.R.Civ.P. 41(a)(1)©. 2 After the district court, on November 1, had endorsed “Granted and so ordered” on the notice of dismissal, Pocklington interposed opposition to a dismissal “without prejudice” and renewed his request for sanctions under…
