OPINION AND ORDER

Both plaintiff HHC and defendant York Insurance Company (York) have consented to proceed before an United States Magistrate Judge pursuant to 28 U.S.C. § 636(c) and Fed.R.Civ.P. 73. HHC originally filed this action at law in the Circuit Court of the City of Hampton on August 19, 1997. York brought the ease here by filing a Notice of Removal with this Court on August 19, 1997 pursuant to 28 U.S.C. § 1446(a); and by filing a copy of that Notice of Removal with the Hampton Circuit Court pursuant to 28 U.S.C. § 1446(d).
