MEMORANDUM OPINION

HOBBS, Chief Judge.

This cause is now before the Court on defendant’s motion for summary judgment, filed August 13, 1986. The Court is of the opinion that this motion should be denied.

FACTS

Plaintiff, New Concept Industries, Inc., (New Concept) is a Delaware corporation with its principal place of business in Aberdeen, Mississippi.
