J. PAUL OETKEN, United States District Judge *479Plaintiffs, a group of investment funds known as "Silvercreek," brought this action against Defendants, a set of financial institutions, for conduct relating to the issuance of debt securities by Enron Corporation ("Enron").1 Plaintiffs assert claims under New York state tort law and under federal and Texas securities laws. Defendants Credit Suisse, Deutsche Bank, and Merrill Lynch each move for summary judgment. (Dkt. Nos. 114-15, 121.) For the reasons that follow, the motions are granted in part and denied in part.
