This case was tried to a jury on plaintiff’s first amended petition, defendant’s answer thereto, and the reply of plaintiff. Verdict was returned in favor of plaintiff for $16,750 and judgment rendered thereon.

In plaintiff’s first amended petition it is alleged, in substance:, that he is the duly appointed and qualified administrator of the estate of Spencer Adams, deceased; that there is due and owing him as such administrator the sum of $56,101.19 out of money had and received by defendant, Rogers; that some time prior to September 30,…
