Affirming.
The appellant and defendant below, Tom Jones, was indicted on November 4, 1935, by the Bell county grand jury wherein he was accused of murdering his wife, Flossie Jones, by shooting her with a pistol. At his trial on November 15, 1935 (eleven days after the return of the indictment), he was convicted and punished with death. His motion for a new trial was overruled, and he prosecutes this appeal seeking a reversal upon four grounds as classified in brief of his counsel, but other points are argued in brief which are not embraced in either of the…
