On the 21st day of January, 1942, Bodine Loyd, hereinafter called respondent, filed his first notice of injury and claim for compensation stating that he sustained an accidental injury arising out of and in the course of his employment with Eagle-Picher Mining & Smelting Company, hereinafter referred to as petitioner, on December 9, 1941. An award was filed under date of April 28, 1942, finding that the respondent had been temporarily totally disabled and excusing the giving of the statutory written notice provided by 85 O.
