BROTHERTON, Justice:

The appellant, Andrew G. Hlavacek, was indicted by the Grand Jury of Greenbrier County, West Virginia, on July 29, 1988, and charged with one felony count of possession of marijuana with the intent to deliver. After entering a plea of not guilty, the appellant moved to suppress the introduction of marijuana into evidence at trial. The motion was denied and the appellant was subsequently convicted of the misdemeanor offense of possession of marijuana and placed on probation.
