Respondent Eldon Blankenship (the “claimant”) filed for benefits with respondent Director, Office of Worker’s Compensation Programs, United States Department of Labor (the “Director”) under the Black Lung Benefits Act, 30 U.S.C. § 901 et seq. (the “Act”). The Act extends benefits to those suffering total disability due to black lung disease. Claimant was awarded benefits, with interest accruing from the date he filed his claim.
