The plaintiff, N. 0. Froling, brought this action in the county court of Cass County against the defendant, Felix Farrar, to recover on an account for goods, wares, and merchandise sold and delivered, and for labor performed, “duly assigned to the Plaintiff.” The summons and complaint were filed in the office of the clerk of court December 29,1948, together with the affidavit of Roy G.
