Plaintiffs filed their complaint seeking construction of the last will and testament of Louis Lavin, who died testate in Chicago on September 23, 1945, leaving him surviving as his heirs-at-law Anna Lavin, his widow, four sons and three daughters, all of legal age. By clause 3 of his will be bequeathed to his wife Anna Lavin ‘ ‘ all monies on deposit in my name in any bank or banking institution.” At the time of his death he had on deposit with the Central National Bank of Chicago the sum of $6,218.01, and with the Farmers and…
