This action, framed under the fifth subdivision of § 143 of the Code of 1848, corresponding with § 167 of the present Code, was brought to recover real property, without damages for the withholding thereof, and is the substitute provided by .the Code for the action of ejectment under the former practice. It was commenced in the year 1848, in pursuance of the concurrent resolution of the legislature of the 6th of April of that year, in relation to “ manorial titles.”
