Wing, J.
An indictment was presented to the district court for the county of Wayne, at the December term of the court in the year 1846, against defendant, Edwin Jerome, for an alleged libel on Pierre Teller, to which a general demurrer was filed. Upon the argument of the demurrer, the following questions were made,'viz;
1. Is the published matter set forth in said indictment libelous?
2. Is the same set forth in said indictment with legal certainty ?
' The presiding judge of the district court deeming these questions of sufficient importance to have the same submitted” to this court…
