Booth Newspapers, Inc., doing business as The Ann Arbor News, appeals an order of the Washtenaw Circuit Court which ordered Booth to produce to American Employers Insurance Company unpublished, nonconfidential photographs taken of a fire scene by a Booth photographer. Booth argues that a qualified privilege exists under the First Amendment of the United States Constitution and under Const 1963, art 1, §5 to shield it from producing nonconfidential materials generated through its news gathering function.
