Appellate Court of Illinois

1Opinion of the CourtJustice Jones

The defendant was convicted of aggravated battery in the Circuit Court of Fayette County. He was sentenced to probation for a term of two years. He appeals his conviction, claiming that (1) the trial court neglected to enter judgment on the jury’s verdict of guilt, (2) the court abused its discretion in permitting defendant’s appointed counsel to withdraw on the day of trial and in denying defendant’s motion for a continuance on that day, and (3) the court did not allow him to present evidence of his theory of the case. We only consider the first argument.
