Associate Justice of the Supreme Court of the District of Columbia.
This is an appeal from a judgment of the Supreme Court of the District of Columbia on a finding and determination by the court as a matter of law, upon an agreed statement of facts, in an action upon a promissory note in the sum of $7,456.89 and interest, that the appellant within three years before.the commencement of said action so acknowledged the indebtedness as to take the ease out of the statute of limitations.
