Bivins was convicted at the May term, 1932, of the superior court of Dooly county, of the offense of embezzlement of funds of Vienna State Bank. He filed his motion for a new trial, which was overruled by the trial court on the 10th of September, 1932, and the case was brought to this court for review. The judgment of the lower court was affirmed by this court on the 3d *300of August, 1933. A petition for certiorari was presented to the Supreme Court, and was denied on the 25th of October, 1933, but was not sent back to this court until March 9, 1934.
