This case is brought to this court under the statute providing for a so-called direct appeal from the District Courts and prescribing the procedure therefor, enacted in 1917. (Daws 1917, Ch. 32.) That statute provides for the review by this court on appeal of any judgment or order theretofore reviewable by proceedings, in error, but without repealing, modifying or changing the statutory provisions for a review by that method.
