This action was instituted February 4, 1942, to recover judgment against Owyhee County, defendant-appellant, on account of payments made by plaintiff-respondent of principal, interest and taxes paid on a contract of sale of real property, situate, lying and being in Owyhee County, Idaho. The facts leading up to and necessitating the institution of said action, briefly stated, are as follows: May 4, 1932, Owyhee County, by and through its proper officials, entered into a contract for the sale of certain real property to respondent, John T.
