Plaintiff in error will be designated as. defendant, and defendant in error as plaintiff, in accord with their respective titles in the trial court.

Plaintiff recovered a judgment for $2,000 for injuries suffered by him in the services of the defendant as teamster in the latter’s coal mine near Krebs, Olda., upon the grounds of negligence and liability in respect to obvious condition of the mine at the time and long before he undertook the work in question. The plaintiff had worked in this mine four or five years, and as such teamster four or five months prior to the time…
