Charles Milburn was injured in the performance of his duties as a Georgia State Trooper when he lost control of his car and crashed into a guardrail while engaged in a high speed chase of a car driven by a criminal suspect. Milburn sued the driver of the car he was chasing to recover for personal injuries he suffered in the crash and served a copy of the action on his uninsured motorist carrier, Nationwide Insurance Company, pursuant to OCGA § 33-7-11 (d).
