By an order of the Supreme Court dated the 26th day of July, 1937, the issues in this action were referred to me as official referee to hear, try and determine the said issues, which order directed that an interlocutory judgment may be taken, of course, with the same force and effect as if the issues were tried at a regular term of this court, and ordering that judgment may be taken, of course, upon the report of the official referee and his *106findings of fact and conclusions of law with his decision thereon, pursuant to section 1174 of the Civil Practice Act.
