MEMORANDUM OPINION

KANE, Senior District Judge.

Rosalie Lampl, Chapter 13 debtor, brought this action to recover her alleged interest in property she conveyed to Keith Smith in 1988 and damages. She claims Smith breached his agreement to sell the property and split the proceeds with her; misrepresented his intentions with respect to the property; misappropriated her interest in the property; and took advantage of his position of trust to induce her to convey title to him.
