BRIGHT, Senior Circuit Judge.
The United States, pursuant to 18 U.S.C. § 3731, appeals the district court’s 1 order granting a new trial after a jury found Gene McBride guilty of four counts of willfully and knowingly making false statements to a government agency in violation of 18 U.S.C. § 1001. The Government contends the district court abused its discretion in granting the new trial. For reasons discussed below, we affirm.
