PICKERING, Circuit Judge:

Before the court is the government’s appeal from the district court’s order granting defendant Richard Wall’s Fed. R.Crim.P. 33 motion for a new trial. We conclude that the district court abused its discretion when it granted the motion.

Wall was indicted on charges of conspiracy involving a scheme to defraud the state of Louisiana of the proper quality of steel for use in Louisiana Department of Transportation and Development (LA-DOTD) road construction projects.
