MEMORANDUM OPINION

TURK, Chief Judge.

Petitioner, Joseph Franklin Edwards, Sr., was convicted in the Circuit Court of Franklin County on December 9, 1968, of breaking and entering and possession of a sawed-off shotgun. He was sentenced to the Virginia State Penitentiary for twenty years with twelve suspended and a five-year sentence to run concurrently with the first. On April 7, 1973, the petitioner escaped from Penitentiary Camp No. 7, White Post, Virginia. Petitioner was subsequently convicted in North Carolina on North Carolina charges, and sentenced to the North Carolina Penitentiary.…
