MORROW, Judge.
This is a petition for mandamus. The petitioner, Jesse Fread, was indicted, tried and convicted for murder, and judgment and sentence condemning him to confinement in the penitentiary for five years was duly entered in the District Court of Navarro County, from which judgment he prosecuted appeal in due time to this court, giving notice of appeal in the manner and at the time required by law, which is duly entered.
