Under an indictment charging him with murder, Millard Lee was convicted. He moved for a new trial; the motion was overruled, and Lee excepted. The evidence shows that Lee attended church, and after the services asked permission of Miss Lillie Suttles, a young lady, to accompany her home. She replied that she had a previous engagement; whereupon he drew his pistol from his pocket and shot her twice, inflicting a wound which produced her death.
