The plaintiff in error was convicted of the offense of voluntary manslaughter. He excepts to the judgment refusing a new trial. The testimonj'- in the case is extremely voluminous, but is substantially as follows: On the part of the State it was shown that after a trial in a justice’s court, in which Carter (the plaintiff in error) was one of the parties and the deceased, Reed, was a witness, Reed, in company with several other persons, started from the court-house toward home.
