Katina Nixon was injured when her economy-sized sedan was struck from behind by a school bus while she was nine months pregnant. After her baby was determined to have cerebral palsy caused by a perinatal stroke, she brought an action for negligence, on her own behalf and as the “next friend” of her daughter, against the Pierce County School District (hereinafter, “the District”).
