Plaintiff Robert Provost1 appeals from a May 19, 2000 judgment of the United States District Court for the Southern District of New York (George A. Yanthis, Magistrate Judge) granting partial judgment as a matter of law to the defendants following a trial and a jury verdict for the *151plaintiff. One of the defendants in that trial, John Roper, cross-appeals the portion of the same judgment that awarded the plaintiff nominal and punitive damages against him in accordance with the verdict.
