Affirming.

Searcy Battle was an employ of the appellant, P. Ban-non Pipe Line Company. He was a strong, healthy man, thirty-six years of age, and of sober, industrious habits. He had been an employe of the appellant, for several months, and had been doing the same work for it, during that time. The appellant owned and operated a factory for the making of terra cotta tile, pipe, and brick, and used, for the purpose, large quantities of clay and shale.
