Y. Wiess and his two children, Percy and Ruth Wiess, sued John B. Goodhue and wife and A. F. Goodhue and wife to recover a strip of land twenty feet wide and one hundred and eighty feet long off the north side of lots 241 and 242 of block 48 in the city of Beaumont. The suit was in trespass to try title and for damages. They subsequently brought another suit against' the same parties for the recovery oí a twenty-foot strip of equal length lying immediately south of that involved in the first suit and alleged to be a part of the same lots.
