The record in this case is voluminous, containing an indictment in six counts, Jive grounds of demurrer, exceptions pendente lite on four rulings, a motion for a new trial containing fifty-two grounds, and other things, the whole making a record of about three hundred type-written pages. Some of the pleadings contain reiterations of issues raised elsewhere and otherwise in the record. Each assignment of error has been carefully considered, but we do not deem it necessary to discuss in detail each issue raised, and, therefore, only our rulings in headnotes 1, 25, and 35 will be elaborated…
