This complaint for trespass and ejectment was brought by the plaintiffs to recover possession of certain premises owned by them and occupied by the defendant. They allege therein that the defendant had failed to pay the monthly rent in accordance with the provisions of a written lease. After an adverse decision in the district court, the case was heard, on defendant’s appeal, before a justice of the superior court and a jury.
