This case, under the title Simper v. Brown et al., was here before. 74 U. 178, 278 P. 529. The parties, Simper v. Scorup, on this appeal are the same and only parties as on the first appeal. On the prior appeal Scorup appealed from a judgment against him and in favor of Simper in the sum of $4,500. That judgment, for reasons stated in the former opinion, was reversed and the case remanded for a new trial. A retrial before the court resulted in a judgment in favor of Scorup, no cause of action, from which Simper appeals. He complains of the findings and conclusions and the judgment based upon…
