JEFFERSON (Bernard), J.

By an information defendant and Anthony Gene Rivers were charged with the commission of robbery in violation of Penal Code section 211. It was also alleged that in the commission of the offense, defendant and Rivers used a rifle, a firearm, within the meaning of Penal Code sections 12022.5 and 1203.06, subdivision (a)(1). Defendant and Rivers were tried jointly. The jury found defendant guilty of second degree robbery but found the use-of-a-firearm allegation to be untrue.
