Appeal from a judgment of tbe superior court for Snohomish county, Denney, J., entered December 26, 1903, upon a trial and conviction of murder in the first degree.

The appellant was convicted of the crime of murder in the first degree, and from the judgment and sentence of the court, this appeal is prosecuted. It appears that the appellant and the deceased were rivals in the saloon business, at the town of Darrington, in Snohomish county. The appellant opened the first saloon in the town, and the competition caused by the saloon afterwards opened by the deceased curtailed the appellant’s business, to such an extent as to cause considerable ill feeling on his part toward the deceased.
