This matter is before the Court on the parties’ cross-motions for summary judgment (“Pis.’ Mot.” and “Defs.’ Mot.,” respectively) pursuant to Federal Rule of Civil Procedure 56. 1 The plaintiffs bring this lawsuit against the Department of Labor (“Labor”) and its Secretary seeking declaratory and injunctive relief.
