I. INTRODUCTION
On July 8, 2009, plaintiff Sun Life Assurance Company (“Sun Life” or “plaintiff’) filed the present action against defendant Jonathan S. Berck (“Berck” or “defendant”), trustee of the Daniel Berman Insurance Trust (the “Berman Trust”).
