11 The court vacates today the Court of Civil Appeals' opinion, reverses that part of the trial court's judgment which summarily declares1 that Lynn Hickey Dodge, Inc. [Lynn Hickey] was the owner of the vehicle at the time of the accident, and remands the cause for further proceedings. According to the court's opinion, whether Lynn Hickey was the owner presents a fact question for the jury. While I concur in the court's pronouncement, I write separately to provide my own analysis of the issues tendered by this appeal.
