The defendant is charged with one count of the class C felony of criminal possession of marihuana in the first degree in violation of Penal Law § 221.30 and seeks an order setting bail. The People have opposed the motion, arguing that there is reasonable cause to believe the defendant is homicidal and suicidal. Because of the sharp fact issues, this court directed that a hearing be held. Testimony was taken on October 28 and November 12, 1997.
