Appeal by the defendant from a judgment of the Supreme Court, Kings County (Mangano, Jr., J.), rendered June 22, 2010, convicting him of murder in the second degree (two counts) and criminal possession of a weapon in the second degree (four counts), upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
Contrary to the defendant’s contention, he was not deprived of his right to be present at all material stages of trial. Since the pretrial proceedings at issue only involved questions of law or procedure, his presence was not required (see People v Fabricio, 3 NY3d…
