The judgment at issue here represents the disposition after a bench trial of six consolidated actions arising from the operation of a financially troubled bank over the course of more than a decade. The six actions included claims concerning unpaid capital assessments and calls; requests for accountings; allegations of breach of fiduciary duty, fraudulent misrepresentation and transfer; and claims upon personal guarantees and for personal liability on a promissory note.
