In this action, the plaintiff, Craig Collins (“Plaintiff’ or “Collins”), alleges that Manchester Police Officer Jean Roers (“Defendant” or “Roers”), accompanied by her K-9 partner Cody (“K-9 Cody”), arrested Plaintiff on November 8, 1998 without probable cause. Plaintiff filed this action on October 31, 2001 against the City of Manchester, New Hampshire (the “City”), and Roers pursuant to 42 U.S.C. § 1983 for violation of his right to be free from unreasonable seizure secured by the Fourth and Fourteenth Amendments to the U.S. Constitution.…
