This action was filed in the district court of Pontotoc county by Carey, Lombard, Young & Company, a corporation, to recover $295.70, with interest, from the board of county commissioners of Pontotoc county.

The plaintiff in error appeared as defendant below, and the defendant in error as plaintiff. They will be referred to as they appeared in the lower court.
