This was an action on the case by David Mohney and William Girtz against George Cook, for injuries done to the plaintiffs’,boat, by a dam erected by defendant in Redbank Creek, in Armstrong County. The evidence in the case shows that the plaintiffs were the owners of a flat-bottomed boat, which was laden with pig-metal, and was descending the creek on its way to market, in the month of November, 1852.
