The questions raised by this appeal relate only to the contributory negligence of the plaintiff’s driver. The negligence of the defendant is admitted. The main question is whether the failure of the plaintiff’s driver to comply with the provisions of section 834 of the Vehicle Code of 1929, P. L. 905, as amended by the Act of July 16, 1935, P. L. 1056 1 75 PS sec. 432, directing the carrying of flares and the placing of a lighted flare in front, to the rear, and on the highway side, of a commercial vehicle disabled on the highway during the period when lighted lamps…
