This is a “delinquent child” case, brought under Art. 2338 — 1, Vernon’s Ann.Civ.St. The defendant (appellant here) is a negro boy, 12 years old. The suit was brought in the juvenile (county) court of Bastrop County, where defendant resided, and was transferred to and tried in the district court of that county, upon the county judge’s re-cusing himself. The trial was to the court without a jury, and the judgment decreed the defendant a delinquent child, and committed him to the State School for Boys at Gatesville for an indeterminate period of time, not extending…
