In September, 1920, appellant Frank Kveton filed his application in the county court of Austin county praying for the probate of a will alleged to be the will of his father, John Kveton, Sr.

Appellees contested said application, and, upon a hearing in the county court, the probate of the will was refused. From such judgment of refusal proponent, Frank Kve-ton, appealed to the district court. Upon a hearing in the district court, judgment was rendered probating the will, and upon appeal from such judgment this court reversed the same and remanded the cause. Keding et al. v. Kveton, 254 S.
